A RESOLUTION OF 'l'lm CITY CCMHISSION OF DtE CIT'l
OF CLEARWATER. FLORIDA. DECLARING A CERtAIN 4.24
ACRE TRACT OF LAND SURPLUS AND lIUTitORlZING TIlE
EXClIANGE OF SUCH TRACT WITH PAC'l', INC. FOR onlER
LAND HAVING A COMPARABLE APPRAISED VALUE.
WHEREAS, tho City Comadssion of tho City of Clearwater through
tho adoption of Resolution No. 79.- 101 declared that the City would be
unable to commence construction or construct n perfo~ng arts center on
tho 4.24 acre tract identified beL~; and
WHEREAS, because of the ~eason8 sct forth in Resolution no. 79
the City of Clearwater has no prescnt or future practicaL UDe or need
for such tract; and
WHEREAS, by declaring the 4.24 Acre tract surplus and exchanging
it with PACT, INC., the City can cause a performing arts center to be
constructed by PACT, INC., operated in the pubLic interest, and given to
the City when aLL borrowing is repaid; and
WHEREAS, because of the factors set forth above, such tract is
no longer needed for public use by the City of Clearwater and thus is
surplus to the needs of the City of Clearwater; and
WHEREAS, it would be advantageous for the City of Clearwater to
exchange such tract for the tract described in Exhibit B haVing a comparabLe
appraised value which tract is to be used for recreational uses; and
WlmREAS, an advertised public heariug relating to this declaration
was held on November 15, 1979:
NOW, T!lEREFORE, DE I'.C RESOLVED BY THE CITY CCllMISSION OF
TUE CITY OP CLEARWATER, FlORIDA, IN SESSION DULY AND
REGULARLY ASSEMBLED, AS !:'OLLQlS:
1. That the City Commission of the City of Clearwater, FLorida.
hereby declares the 4.24 acre tract of land identified on ~ibit A,
attached hereto and made a part hereof, to be surplus real property no
longer needed by the City of Clearwater for public use.
2. That the City Commission, based on analysis by City stoff.
hereby finds the l~o tractA described in Exhibits A and B attached hCTeto,
to be of comparable value.
3. That appropriate officials arc hereby authorized to execute
documents necessary to implement the exchange of the two tracts described
in exhibits A and B attached bereto.
