A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA, DECLARINO
THA T THE CIT~' WILL BE UNABLE TO CONSTRUCT
A PERFORMING AR. 'IS CENTER. ON THE PRO PER TY
DEEDED TO THE CITY BY KAPOK TREE INN, INC.

WHEREAS, the Kapok Tree Inn, Inc. by deeds dated December Z7,
1977, and December Z8. 1977, transferred a tract of land to the City of

Clearwater for the purpose of constructing thereon a performing arts
center; and
WHEREAS, the City of Clearwater ~ccepted such gift pursuant
to Resolution No. 77-133 adopted December Z8. 1977; and
WHEREAS, the City of Clearwater since receiving the gift of the
land has studied and considered the various methods whereby the City
.might directly construct the performing arts center on the tract and has
found that it will not be feasible for the City to undertake such a project
either within the time set out in Resolution No. 77-133 or in the foreseeable
future; and
WHEREAS, Kapok Tree Inn, Inc. has been made aware of this
determination and has agreed to provide a waiver of the covenant contained
in each deed as more particularly described in Resolution No. 77-133;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater, Florida.
after study and investigation by City staff hereby declares that the City of
Clearwater will be unable to comrnence construction or construct a performing
arts center on the land donated to the City of Clearwater by the Kapok Tree
Inn, Inc. either within the thne set forth in the deeds and Resolution No.
77 -133 or in the iores eeable futul" e.
