A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA, ESTABLISHING
THE PROCEDURE TO BE FOLLOWED IN RESOLVING
THE CHARGES FILED AGAINST JOHN F. HURLEY,
PURSUANT TO SECTION 421.07, FLORIDA STATUTES.
WHEREAS, the Mayor has preferrcd chargcs against John F. Hurley
pursuant to Section 421.07, Florida Statutes: and
WHEREAS, the statute requires that John F. Hurley be given an
opportunity to respond to the charges either in person or by counsel~ and
WHEREAS, it is the belief of the City Commis sion that a fact
finder should be appointed to hear the evidence to be presented by both
sides and prepare a record and suggested findings of fact to be submitted
to the City Commission:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
. IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater, Florida,
hereby appoints William Sizemore of Tampa, Florida, as hearing examiner
to conduct a fact finding hearing relating to the charges filed against
John F. Hurley, Commissioner of the Clearwater Housing Authority,
pursuant to Section 421.07, Florida Statutes.
2. That William Sizemore is. to conduct such fact finding hearing
utilizing Chapter 120. Florida Statutes, as a guide and to prepare a record,
a copy of which is to be submitted to each City Commissioner together with
his suggested findings of fact.
3. That following such hearing and upon completion of the record
and suggested findings of fact, the City Commission shall schedule a further
meeting to consider the record and suggested findings and reach a final
decision.
