RESOLUTION NO. 92-9
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
ASSESSING CERTAIN REAL PROPERTY HAVING A POST OFFICE
ADDRESS OF 136 NORTH PROSPECT AVENUE, 138 NORTH PROSPECT
AVENUE, 901 DREW STREET, 90l~ DREW STREET, AND 903 DREW
STREET , CLEARWATER, FLOR IDA, AS OEseR I BED MORE
PARTICULARLY HEREIN, IN THE TOTAL AMOUNT OF $8,830.00
FOR THE COSTS OF DEMOLITION INCURRED IN REMOVING
DANGEROUS STRUCTURES, WITH THE CONSENT OF THE OWNERS.
WHEREAS, pursuant to Chapter 138 of the Clearwater Code of Ordinances and
the Standard Building Code, the Building Official determined that certain real
property described herein and the buildings situated thereon were unsafe,
unsanitary, unfit for human habitation, and dangerous and detrimental to the
health, safety, and general welfare of the community, and did not properly comply
with the requirements of said Code, and found that an emergency existed which,
in his opinion, involved imminent danger to human life and health, and ordered
the demolition of the buildings; and
WHEREAS, the owners of the property signed Waivers of Notice and Hearing,
requesting the City of Clearwater to demolish the structures located at the
property and for the City of Clearwater to file a lien against the property for
the cost of demolition; and
WHEREAS, the City of Clearwater has caused the demo lit ion of the bui ldings,
and the cost of such work should now be assessed as a lien on behalf of the City
of Clearwater against the property; now, therefore,
BE IT RESOLVED BY THE CITY COMM1SSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The Building Official having ordered the demol ition of the
buildings situated on the following described property:
Metes and bounds description in deed recorded at O.R.
Book 6879, page 1314, public records of Pinellas County,
Florida (From NW Sect cr run E. 210 ft then S. 122 ft to
POB then E. 100 ft then N. 92.5 ft then E. 110 ft then
S. 180 ft then H. 210 ft then N. 88 ft to POB, less
road) .

and the City of Clearwater having now completed said work, the City Commission
does hereby assess and charge a lien on behalf'of the City of Clearwater against
the property for the necessary costs incurred as follows:

Section 2. As soon as practicable, a Certificate of Indebtedness against
the property for the amount of assessment shall be prepared, which certificate
shall constitute a lien prior to all other liens except the lien for taxes. Said
certificate, when issued, shall be payable to the City in not exceeding ten (10)
equal annual installments with interest at a rate not greater than eight percent
(8%) per annum.
Section 3. The City Clerk is hereby directed to prepare a Notice of Lien
in the amount of the assessment against said property, and to record the same in
thp. Public Records of Pinellas County, Florida.
Section 4. This resolution shall take effect immediately upon adoption.
