MENT IN CONNECTION WITH DISTRIBUTION OF SUCH J9Fi4«. y !6;r. BONDS AND OTHER ACTION IN CONNECTION WITH THE ISSUANCE AND DELIVERY OF SUCH BONDS; DESIG- NATING THE PAYING AGENT IN CONNECTION WITH THE BONDS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Clearwater, Florida (hereinafter called "City") has duly enacted Ordinance No. 1765, on March 17, 1976, authorizing the issuance of not exceeding $1, 650, 000 General Obligation Bonds (the "Bonds") of the City; and WHEREAS, pursuant to notice hretofore duly published for the sale of the Bonds, the City Commission of the City met on May 30, 1979, at 12;00 Noon, EDST, to open and consider all bids submitted for the Bonds; and WHEREAS, bids, copies of which are attached hereto and made a part hereof, were received from the following bidders: Bidders Arch W. Roberts & Co. William R. Hough & Co. Citizens & Southern R. K. Johnson & Co., Inc. Trust Company Bank Paine, Webber, Jackson & Curtis Southeastern Municipal Bonds, Inc. Southeast First National Bank of Miami Merrill Lynch White Weld John Nuveen & Co., Inc, and WHEREAS, after due considem tion it appears to the City Commission that the bid of Arch W. Roberts & Co. (the "Purchaser"), for the Bonds is the beet bid received; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: SECTION 1. Bonds maturing in the years 1990-1999, both inclusive, Bond Numbers 136-330, shall be redeemable prior to their stated dates of maturity at the option of the City, as a whole, or in part in inverse order of their stated maturities, and by lot within a maturity if less than an entire maturity is to be redeemed, on January 1, 1989, or on any date thereafter prior to maturity, at par and accrued interest to date of redemption plus a premium of 1/2 of It of the par value thereof for each year or portion thereof from the date of redemption to the date of maturity; such premium however not to exceed 38 of the par value thereof. SECTION 2. The distribution of the Official Statement in connection with the issuance of the Bonds is hereby ratified and confirmed and the proper officers of the City be and they are hereby authorized to execute final Official Statements and to deliver same to the purchaser of the Bonds. SECTION 3. The proper officers of the City be and they are hereby authorized and directed to execute the Bonds when pre- pared and deliver same to the purchaser upon payment of the ' purchase price pursuant to the conditions stated in the Official Notice of Sale.
