79-38 Y t? F i i t C 1) RESOLUTION No. 79 -38 Y id$ 1'x A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER ACCEPTING AN ADDITIONAL GRANT OFFER APPROVED BY THE U. S, ENVIRON- MENTAL, PROTECTION AGENCY FOR USE IN CONSUNCTION WITH THE MARSHALL STREET POLLUTION CONTROL FACILITY EXPANSION. WHEREAS, the City Commission of the City of Clearwater, Pinellas County, Florida, herein called the "Applicant", hae previously made application for grant funds by Grant Application No. C120405-01-Z under Public Law 92-500 for construction of certain public works, generally described as Clearwater Marshall Street Pollution Control Facility Expansion; and WHEREAS, the U. S. Environmental Protection Agency and the Florida Department of Environmental Regulation made an offer to the Applicant dated October 7, 1974, and the Applicant on October 21, 1974, accepted such offer as proffered; and WHEREAS, the Applicant on June 13, 1977, requested an increase in the grant amount due to certain modifications to the project; and WHEREAS, the Environmental Protection Agency on March Z7, 1979, approved an additional offer in the amount of $133, 085, which increases the total offer to $5, 746, 640; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the Applicant accepts such additional offer as proffered inasmuch as the construction of the Clearwater Marshall Street Pollution Control Facility Expansion is necessary and the acceptance of this additional offer will assist in deferring the cost of construction of the aforesaid. 2. That the Applicant agrees to comply with the General Conditions and Special Conditions of the grant agreement. -1- .,, Reso:, 1793$. 7777, 3. That Anthony L. Shoemaker as City Manager is hereby authorized to execute on behalf of the Applicant the additional offer in form as submitted by the United States and in conformity with said Act and, further, that the said Anthony L. Shoemaker as City Manager is hereby authorized to furnish such additional information and take such other action as may be necessary to enable the Applicant to fully meet the requirements of said offer and further, that said Anthony L. Shoemaker as City Manager is designated as the authorized representative of the Applicant. 4. That certified copies of this Resolution be included as part of the Applicant's acceptance of said additional offer and that this Resolution shall be submitted as a part thereof. 5.
