A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER AUTHORIZING THE CITY
ATTORNEY'S OFFICE TO BRING AN ACTION RELATING
TO SANDAL COVE APARTMENTS TO REQUIRE THE
DEVELOPER TO COMPLY WITH CITY ORDINANCES
RELATING TO TAP IN PERMIT AND CHARGES,
WHEREAS, a development known as Sandal Cove Apartments is
located in Safety Harbor, Florida; and
WHEREAS, the City of Clearwater has a sewer line running along
such development; and
WHEREAS, the City of Clearwater has learned that the developer
has tapped into the sewer line without obtaining a permit or paying the required
tap in charges;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Attorney's office is hereby authorized to bring an
action against the developer of Sandal Cove Apartments, Gerald Custer,
and to take all action necessary to obtain compliance with utility code require-
ments relating to tap in permits and tap in charges and to collect for any tap
in made without benefit of a permit.
2. That this Resolution shall take effect immediately upon its
adoption.
