RESOLUTION
No. 79
A RESOLUTION DECLARING THE CITY OF CLEARWATER'S
OPPOSITION TO PROPOSED LOCAL BILLS WHICH PURPORT
TO ESTABLISH WATER AND SEWER SERVICE AREAS AND
TO ESTABLISH THE ELIGIBILITY OF COUNTIES WITH
MUNICIPAL SERVICE TAXING DISTRICTS (MSTU'S) TO
RECEIVE REVENUE SHARING FUNDS.
WHEREAS, Local Bills have been proposed by Pinellas County by
which it is sought to establish water and sewer service areas and the eligibility
of MSTU's to receive revenue sharing funds; and
WHEREAS, it is apparent that the primary concern of the Board of
County Commissioners of Pinellas County is not the distribution of wholesale
water to all residents of this County but rather a desire to retail water
services in competition with municipal governments and thus act as a
municipal government in the unincorporated areas; and
WHEREAS, the Board of County Commissioners should represent
each and every citizen of Pinellas County and not just those individuals who
live in the unincorporated areas; and
WHEREAS, this could be construed to establish a charter government
without approval by the voters at a referendum; and
WHEREAS, these acts seek to place the Board of County Commissioners
in the position of mediating and adjudicating disputes in certain areas whether
these disputes arise between the County and a municipality or between two
municipalities; and
WHEREAS, Pinellas County has moved to perpetuate enclaves and not
provide many of the needed urban services to these unincorporated areas; and
WHEREAS, to permit charter and non-'charter counties to receive
revenue sharing funds for special district services would further reinforce
the current enclave arrangement and deter a more coherent pattern of
municipal incorporation; and

WHEREAS, the establishment of unincorporated taxing districts
would serve to discourage annexation; and
WHEREAS, the distribution of revenue sharing funds for MSTU'a
would reduce the capabilities of the incorporated municipalities to meet
the full range of urban services; and
WHEREAS, if total revenue sharing funds are not increased, existing
municipal capabilities to provide services will be reduced;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. The City Commission of the City of Clearwater, Florida, does
hereby declare its strong opposition to proposed Local Bills introduced by
the Board of County Commissioners of Pinellas County which seek to establish
water and sewer service areas both for the unincorporated and the incorporated
areas of Pinellas County and seek to establish the right of Counties to receive
municipal revenue sharing funds for use in multiple service taxing districts,
and does hereby request that the Pinellas County Legislative Delegation
defeat these bills as being in conflict with the home rule authority of
municipalities and which is thus contrary to the desire of the people of
Pinellas County as expressed in the elective process.
2. That copies of this Resolution be sent forthwith to the Pinellas
County Legislative Delegation, the Pinellas County Board of County
Commissioners and each municipality in Pinellas County.
3. That this Resolution shall become effective immediately upon
its passage.
