A RESOLUTION ASSESSING ABUTTING REAL PROPERTY
THE COST OF REPAIRING A SIDEWALK.
WHEREAS, the City Commission of the City of Clearwater on

December 7, 1978, adopted Resolution No. 78-133 declaring its intent to
repair the sidewalk abutting Lots 14 and 15, Bidwell's Oakwood Addition;
and
WHEREAS, after notice being published on December 11, 1978, and
December 18, 1978, a public hearing was held on December 21, 1978; and
WHEREAS, following such public hearing the City Commission '
adopted Resolution No. 78-134 ordering the owners of such lots to repair
such sidewalk within thirty (30) days of the passage of the Resolution; and
WHEREAS, such Resolution was published both on December 29,
1978, and January 5, 1979; and
WHEREAS, by reason of the failure of the owners to repair such
sidewalk within such thirty (30) day period, the City of Clearwater has
repaired such sidewalk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. Pursuant to Section 122 of the Code of Ordinances of, the City
of Clearwater, Florida, 1962, and after public hearing thereon and notice,
the owner of the real property identified in Resolution No. 78-134, passed
on December 21, 1978, described as:
Lots 14 and 15, Bidwell's Oakwood Addition-, according
to the map or plat thereof as recorded in Plat Book 1,
page 46 of the Public Records of Pinellas county, Florida,
having failed to repair the sidewalk abutting such property, and the City of
Clearwater, having now completed the work, does hereby assess and charge

a lien an bahalf of the City of Clearwater, against the above-described real
property for the total cost incurred as follows-

2. That if the-assessment provided for in this Resolution is not paid
within ten (10) days following the adoption of this Resolution, the City shall
prepare a certificate of indebtedness against such property, such certificate
to be payable in not leas than three (3) nor more than tea (10) equal annual
installments at a rate of eight per cent (877) per annum until paid.
3. The City Clerk is hereby directed to prepare such certificate of
indebtedness in the amount of the cost of repair set out herein and file the
same in the Office of the Clerk of the Circuit Court of Pinellas County,
Florida.
4. This Resolution shall become effective immediately upon its
adoption.
