A RESOLUTION OF THE CITY COMMISSION
AUTHORIZING THE CITY ATTORNEY TO APPEAL
THE CASE OF UNITED STATES STEEL CORPORATION
V. CITY OF CLEARWATER, CIRCUIT CIVIL NO.
78-4765-7.
WHEREAS, on January 11, 1979, Judge B. J. Driver issued a
Summary Judgment in the case of United States Steel Corporation v. City
of Clearwater, Circuit Civil No. 7874765-7 which permanently enjoined'the
City from enforcing certain zoning provisions; and
WHEREAS, the City Commission deems it advisable to appeal
such Summary judgment to the Second District Court of Appeal,;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Attorney is hereby authorized to take any and all steps
nece ssary to appeal the decision of the Circuit Court Judge in the case of
United States Steel Corporation v. City of Clearwater, Circuit Civil No.
78-4765-7.
2. That this Resolution shall become effective immediately upon
its adoption.
