A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER FLORIDA, RECOGNIZING
PACT, INC. AS A FUND RAISING, NON-PROFIT
CORPORATION AND COMMITTING THE CITY OF
CLEARWATER TO LEASING A TNA CT OF LAND TO
PACT, INC, FOR THE PURPOSE OF CONSTRUCTING
A PERFORMING ARTS CENTER THEREON.

WHEREAS, the City of Clearwater,Florida, has long recognized

the community need for and support of a performing arts center; and
WHEREAS, the Auditorium Study Committee in May of 1974, concluded
that the demolition of the old auditorium eliminated the one major civic facility
for large assemblies in the City and the remaining public and private facilities
fall far short in providing even minimum conditions with regard to having

the required audience capacity, staging facilities, proper acoustics or

availability for public use; and
WHEREAS, the Kapok Tree Corporation has given to the City approxi-
mately forty (40) acres of undeveloped property near McMullen-Booth Road
with the provision that it be used for construction of a performing arts center
and that development commence within two (2) years of January, 1978; and
y 'N WHEREAS, a group of persons in the Clearwater community has formed
a non-profit corporation, PACT, INC., to organize and direct a private fund

} raising campaign to help finance the cost of a performing arts center in
' Clearwater; and
WHEREAS, PACT, INC, has submitted a report dated October 30,
? 1978, to the City Commission in which a plan for financing a performing
}
arts center is proposed; and
WHEREAS, the City hereby finds the PACT, INC, proposed structure.
for financing the performing arts center to be the best financing structure;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

The City Commission of the City of Clearwater, Florida, hereby
receives PACT, INC. report and officially recognizes PACT, INC, to direct
a fund raising campaign for financing through loans, contributions, and
investments for the development and operation of a performing arts center
in Clearwater consistent with the details of said report.
2. The City Commission hereby commits to least to PACT, INC.
the forty (40) acre tract donated by the Kapok Tree Corporation for a fifteen
(15) year term as described in the report and at a nominal rate, conditioned
on PACT, INC, obtaining financing for construction of a performing arts
center as described in the report.
3. The City Commission hereby expresses its intention to contract
with PACT. INC, for the payment of an annual amount estimated to be
$Z50, 000.00 from the City to PACT, INC, as consideration for use of the
performing arts center by community groups at preferential rental rates as
described in the report, provided that said payment will not exceed the
proportionate cost attributable to use of the performing arts center by
community groups when such payment is added to rental receipts collected
from such community grays.
4. This Resolution shall take effect immediately upon adoption.
