A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA, AMENDING
RESOLUTION NO. 78-100 TO REFLECT A CHANGE IN
OWNERSHIP AND IN THE DESCRIPTION REVEALED
BY A TITLE SEARCH AND SURVEY,
WHEREAS, the City Commission on August 17, 1978, adopted
Resolution No. 78-100, declaring its intent to acquire a permanent easement
for channel widening purposes as part of a drainage project for Stevenson
Creek between Palmetto Street and Betty Lane bridges in Clearwater,
Florida; and
WHEREAS, a subsequent title search and survey have disclosed
additional interests in the property and an error in two of the calls contained
in the description; and
WHEREAS, it is necessary to amend such Resolution in order to
reflect such changes;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That Paragraph One (1) of Resolutions No. 78-100, passed on
August 17, 1978, be and the same is hereby amended to read as follows:
111. That the City Commission of the City of Clearwater hereby
declares its intent to appropriate a permanent easement for
the purpose of widening the channel of Stevenson Creek for
flood control purposes and to implement a plan of drainage
from Donald K. Conley and Linda J. Conley, his wife, both
of 1101 North Betty Lane, Clearwater, Florida; Elizabeth
P. Barnum, 104 Temple Lane, Largo, Florida; and Grover
C. Eldridge and Georgia G. Eldridge, his wife, 1100 Drew
Street, Clearwater, Florida, which said permanent easement
is described as follows;
Start at the Southwest corner of Lot 7, Block E,
Pinebrook Unit 2, as recorded in Plat Book 23, Page
71, of Public Records of Pinellas County, Florida,
and run South 88.3211711 East, 220.0 feet for the Point
of Beginning; thence run North 1 °2714211 East, 75.0 feet;
thence run South 88`3211711 East, 44. 0 feet; thence run
South 19.5413011 West, 79. 06 feet; thence run North
88.32' 17'1 West, 19.00 feet to the Point of Beginning.
Containing . 055 acres, more or less. 11
