RESOLUTION
No. 78 -113
A RESOLUTION AUTHORIZING THE CITY ATTORNEY'S
OFFICE TO BRING AN ACTION TO SEEK RECOVERY FOR
SANITARY SEWER USE BY A COMMERCIAL BUSINESS.
WHEREAS, at some date in 1974 A-OK INDUSTRIES, III ORPORATED,
doing business as Skycrest Car Wash, at 1818 Gulf to Bay Boulevard, installed
a deep well on its property and used and continues to use water from said
well for its commercial car wash business, dispensing such water and other
waste materials into the sanitary sewerage system of the City; and
WHEREAS, on or about April 1, 1975, A-OK INDUSTRIES, INCORPORATED,
made application to the City to connect its place of business on the sewer
system and such business was thereafter connected; and
WHEREAS, the business has no meter attached to its well in order
to report the amount of waste water it deposits into the sewer system and
refuses to attach such a meter for an accurate accounting of the waste water;
and
WHEREAS, A-OK INDUSTRIES, INCORPORATED refuses to pay to
the City the reasonable value of such service and benefit which it is receiving
and has been receiving in connection with the operation of its commercial
car wash business; and
WHEREAS, it is deemed necessary to bring an action aginst A-OK
INDUSTRIES, INCORPORATED to recover the reasonable value of the
services and benefits received . from the City of Clearwater;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS;
That the City Attorney's Office be and it is hereby authorized to
bring an action against A-OK INDUSTRIES, INCORPORATED in the
