A RESOLUTION OF THE CITY COMMISSION OF /Z D
THE CITY OF CLEARWATER, FLORIDA,
DECLARING ITS INTENT TO ACQUIRE AN
EASEMENT FOR CHANNEL WIDENING. .
WHEREAS, it has been determined that an insufficient channel
for Stevenson Creek e3dets between Palmetto Street and Betty Lane
bridges ; and
the existence of an Inadequate channel or stream for
WHEREAS
,
Stevenson Creek has resulted in flooding; and
WHEREAS, re-alignment and widening is required to lower the
water surface elevation, it has been determined that Stevenson Creek at
the above mentioned area be widened to 35 feet at water level; and
WHEREAS, it has been determined that an easement is required
at Stevenson Creek between Palmetto Street and Betty Lane bridges
within the City of Clearwater; and
WHEREAS, the City of Clearwater has the necessary authority,
as well as the necessary finances to acquirei'said easements; and
WHEREAS, considerable effort has been made by the City of Clearwater
in order to acquire the necessary easement and it is now apparent that
condemnation proceedings must be filed against said property owners whose
parcel has not been acquired for said purpose; and
WHEREAS, the purpose of said appropriation is for the health and
general welfare of the residents of the City of Clearwater; and
WHEREAS, the City of Clearwater has surveyed and located its line
for the area of construction and intends in good faith to construct the project
on or over property as hereinafter described;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

1. That the City Commission of the City of Clearwater hereby declares
its intent to appropriate a permanent casement for the purpose of widening the
channel of Stevenson Crack for flood control purposes and to implement a plan
of drainage, from Donald K. Conley and Elizabeth A. Conley, his wife, both
of 1101 N. Betty Lane, Clearwater, Florida, which said permanent easement
is described as follows:
Start at the Southwest corner of Lot 7, Block E, Pinebrook
Unit 2, as recorded in Plat Book 23, Page 71, of Public
Records of Pinellas County, Florida, and run South 88°32'17"
East, 220. 0 feet for the point of beginning; thence run North
1 °17142" East, 75.0 feet; thence run South 88°32117" East,
44.0 feet; thence run South 19°32'17" West, 19.0 feet, to the
point of beginning. Containing 0.55 acres, more or less.
2. The purpose of said appropriation being to implement a plan of
drainage to alleviate severe flooding between Palmetto Street and Betty Lane
bridges in the City of Clearwater, Florida, thereby promoting the public
health, safety and welfare of the City of Clearwater, Florida.
3. The City Manager shall cause written notice hereof to be given
to the aforesaid owners in accordance with Section 139 of the Charter of the
City of Clearwater.
