A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF CLEARWATER, FLORIDA, AUTHORIZING THE CITY
MANAGER TO MAKE APPLICATION TO THE DEPARTMENT
OF ENVIRONMENTAL REGULATION FOR A VARIANCE
FOR THE TEMPORARY DISPOSAL OF EFFLUENT FROM
THE NORTH EAST TREATMENT PLANT.
WHEREAS, the City of Clearwater has not received approval of a

means of discharge of effluent from the North East Treatment Plant; and
:•; '' VMEREAS, the North East Treatment Plant will be completed and
ready for operation in October of 1978; and
WHEREAS, because of the requirements imposed by Section 403. 086,
Florida Statutes, relating to advanced wastewater treatment it will be
tY.s1,? necessary for the City of Clearwater to seek a variance in order that the
North East Treatment Plant can be placed in operation upon its completion; and
WHEREAS, the necessary variance can be sought pursuant to Section

` 17-1. 24(3), Florida Administrative Code; and
WHEREAS, the City Commission believes it would be in the beat
? interest of the City if application for a variance was pursued;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
' OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY
}?• AND REGULARLY ASSEMBLED, AS FOLLOWS:
I, That the City Manager be and he hereby is authorized to make
application to the Department of Enfironmental Regulation for a variance
from the provisions of Section 403. 086, Florida. Statutes, for the temporary
disposal of effluent from the North East Treatment Plant into Upper Tampa
Bay until the pipeline connecting the North East Treatment Plant to the
East Plant is completed.
2. That this Resolution shall. become effective immediately upon its
adoption.
