A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER SUPPORTING THE AMEND-
MENT PROPOSED BY PINELLAS COUNTY TO THE
WEST COAST INLAND NAVIGATION DISTRICT.
WHEREAS, the Pinellas County Commission has submitted a bill
seeking to amend present legislation governing the West Coast Inland
Navigation District; and
WHEREAS, the amendment proposed provides for a withdrawing
county to receive a pro rata refund of surplus assets; and
WHEREAS, such proposed amendment would provide an element of
better local control; and
WHEREAS, the City Commission of the City of Clearwater wishes
to indicate its support for this bill;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater hereby
supports the Bill submitted by Pinellas County amending legislation governing
the West Coast Inland Navigation District, a copy of which Bill is attached
as Exhibit A and incorporated herein.
2. That certified copies of this Resolution be forwarded to the Pinellas
County Legislative Delegation and to the Pinellas County Commission.
3. That this Resolution shall become effective immediately upon
its adoption.

AN ACT relating to the West Coast inland
Navigation District, a special tax district
of the State of Florida, composed of the
Counties of Pinellas, Hillsborough, Manatee,
Sarasota, Charlotte and Lee; amending Section
2, Chapter 61-159,.Laws of Florida, as amended
by Chapter 77-494, Laws of Florida; providing
for a pro rata refund of any surplus district
assets to counties withdrawing as members of
the district; providing an effective date.
Be It Enacted by the Legislature of the State of
Florida:
Section 1. Section 2 of Chapter 61-1590, Laws
of Florida, as amended by Chapter 77-494, Laws of
Florida, is amended to read:
Section 2. The Counties of Lee, Charlotte,
Sarasota, Manatee, Hillsborough, and Pinellas, be
and the same are hereby created into and incorporated,
for the purposes of this Act, into a special tax
district of the State of Florida known as the "West
Coa's't Inland Navigation District," hereinafter
referred to as the District. Such District shall
function and operate by and through its Board of
Commissioners, hereinafter referred to as the Board.
The board of county commissioners of any member county
may, by resolution, withdraw from the West Coast

Inland Navigation District. Any such county shall
continue to be taxed to the.extent of the tax levy
attributable to retirement of such contractual obli.ga-
tions as exist on the date of its withdrawal from the
West Coast Inland Navigation District. If, however,
on the date of a county's withdrawal, there exists-
surplus assets of the District in excess of those
necessar to retire existing contractual obligations;
then such count shall be entitled to receive from the
District a pro rata refund of such sur lus assets. The
amount of the refund shall be calculated based upon the
percentage'of taxes levied in the withdrawing county as
compared to the total amount of taxes levied throughout
the District in the.budget year immediately preceding
such county's withdrawal. In the event that the ro
rata refund of surplus assets to a count includes the
distribution of real ro ert the District shall, to
the greatest extent possible, insure that the real
ronerty distributed to a withdrawinz county is located
,rithin zts boundaries.
Section 2.' This Act shall take effect imme-
iatel.y upon becoming a law.
