WHEREAS, the City of Clearwater conducts an ongoing land use planning program consistent with Chapter 163, Florida Statutes; and WHEREAS, the City implements this plan through zoning, subdivision and other rules related to the regulation of development; and WHEREAS, under the current state of law the rights of private property owners are protected from arbitrary and capricious acts of government; and WHEREAS, the Committee Substitute for Senate Bill 261 would circumscribe the police powers of government, diminish the presumption of legislative validity and wrongfully transfer legislative powers to the judicial branch of government; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the City Commission hereby opposes the passage of the Committee Substitute for Senate Bill 261 or any like bill, 2. That the City Manager institute appropriate and timely measures to express this opposition to members of the legislature. 3. That this Resolution shall become effective immediately upon its adoption. 4.
