RESOLUTION
No. 78 - 42
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER AUTHORIZING THE CITY --
ATTORNEY TO BRING AN ACTION TO REQUIRE
THE REMOVAL OF PILINGS AND A PIER FROM
SUBMERGED LANDS OWNED BY THE CITY.
WHEREAS, the City of Clearwater is the owner of submerged land
located in front of the Flagship Restaurant; and
WHEREAS, pilings and a pier have been erected on such submerged
land without benefit of a permit to do so; and
WHEREAS, requests to the Flagship Restaurant to remove the pilings
and pier have not resulted in the pilings being removed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Attorney's Office be and it is hereby authorized to
bring an action against the Flagship Restaurant to seek removal of pilings
located on submerged land owned by the City of Clearwater.
2. That this Resolution shall take effect immediately upon its
adoption.
PASSED AND ADOPTED this 6th day of April, A. D. 1878.
