A RESOLUTION DECLARING THE CITY Or- CLEARWATER'S

NUMBERS 023 AND 024 Or, 1'ITE PINELLAS COUNTY LEC31S-
LATYVE DE4LEGATION WHICH PURPORT TO ESTABLISH
WATER AND SEWECR SERVICE AREAS AND VEST TITLE IN
f CERTAIN UTILITY LINES,
WHEREAS, Local Bills, being Docket Numbers 023 and 024 of the
Pinellas County Legislative Delegation, have been proposed by which it is
sought to establish in perpetuity ownership to water and sewer lines and the
establishment of water and sewer service areas; and
WHEREAS, it is apparent that the primary concern of the Board of
County Commissioners of Pinellas County is not the distribution of wholesale
water to all the residents of this County but rather a desire to retail water
services in competition with municipal governments and thus act as a
municipal government in the unincorporated areas; and
WHEREAS, supposedly the Board of County Commissioners is to
represent each and every citizen of Pinellas County and not just those individuals
who live in the unincorporated areas; and
WHEREAS, this is an example of the Board of County Commissioners
circumventing home rule and seeking to establish charter government; and
WHEREAS, the Board of County Commissioners seeks to establish
its exclunive domain for the rendering of these services even though the EPA
202 study has not been completed; and
WHEREAS, the Board of County Commissioners seeks by these acts to
exempt private package plants from the effect of these acts which is against the
public interest of residents whether they be within or without the incorporated
areas; and
IYHEREAS, these acts seek to place the Board of County Commissioners
in the position of mediating and adjudicating disputes in certain areas whether
thews disputes arise between the County and a municipality or between two
municipalitles; and

provide many of the needed urban services to these unincorporated areasl and

in the Sixth Judicial Circuit of Pinellas County and these acts would have the
effect of divesting that Court from making a just and equitable determination

COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,

, 1. The City Commission of the City of Clearwater, Florida, does
hexeby declare its strong opposition to proposed Local Bills, being Docket

4 Numbers 023 and 024 of the Pinellas County Legislative Delegation, and the

4`A matters sought to be legislated therein, and does hereby request that the

=t-, Pinellas County Legislative Delegation defeat these bills as being in conflict
with the home rule authority of municipalities, which is contrary to the desire
of the people of Pinellas County as expressed in the elective process,
