A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER OPPOSING PROPOSED
COMMITTEE BILL NO. I ESTABLISHING UNIFORM
MUNICIPAL ELECTION DATES,
WHEREAS, Article VIII, Section 2, of th'e Florida Constitution
provides for municipal home rule; and
WHEREAS, the Legislature through the passage of Chapter lbb of the
Florida Statutes has implemented this Constitutional grant of power; and
WHEREAS, the holding and conduct of municipal elections has been
recognized as a matter of pure local concern best treated through utilization
of home rule powers; and
WHEREAS, Proposed Committee Bill No. I would constitute an
erosion of home rule powers; and
WHEREAS, the City Commission of the City of Clearwater wishes
to oppose this proposed bill;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater wishes to
go an record as being in opposition to Proposed Committee Bill No. 1
establishing a uniform date for municipal elections conducted throughout the
Stake and requests the Legislature to leave the establishing of municipal
election dates to each municipality as part of the Home Rule Power possessed
by the municipality,
2. That a certified copy of this resolution be forwarded to each
member of the Pinellas County Legislative Delegation; to the Speaker of
the Florida House of Representatives; to the President of the Senate and to
the Florida League of Cities.
