INTENT OF ANNEXATION PROCEDURES The following annexation procedures were formulated for three specific purposes: 1. to encourage natural and well-ordered development of municipalities through uniform state regulations, 2. to provide an orderly system for extending municipal x services, and 71?3t rk 3. to distribute fairly and equitably the costs of municipal services, facilities, and representation to all citizens who form a part of the community. 14 ,. GENERAL ANNEXATION PROCEDURES Annexation is initiated by the governing body authorizing a study and report of an area with the potential to be annexed. If deemed appropriate to begin formal annexation procedures, the governing body will pass a resolution proposing to annex. The resolution, published in a newspaper of general circula- tion, will accurately describe the area proposed for annexation and will also set forth the time, date and place for a public hearing. Prior to the public hearing, the report shall be placed on file in the office of the City Clerk for public inspection. In addition, a copy of the resolution providing for the public hearing shall be sent by certified mail to all registered electors residing in the area to be annexed. All interested persons shall be given the opportunity to be heard at the public hearing. If, within a specified period of time after the public hearing, less than 50 percent of the property owners have opposed the annexation, in writing, the governing body may adopt an ordinance effectuating the annexation. Any con- cerned citizen who feels that there has been an irregularity in the annexation proceedings or that there has been a factual error in the annexation report, may appeal to the Florida Annexation Commission for a discretionary review. In order to be annexed under these special pro- cedures, the following condition must exist: that the area proposed for annexation has been completely surrounded by the boundaries of the municipality for a period of not less than two years. Authori- zation of the services report, passage of the resolution, and notification of the effected electors and the public meeting shall occur as described in the general annexation procedures. The Commission shall consist of five members, three of which shall be governor-appointed state represen- tatives and two of which shall be chosen by the county commission from their own ranks when a question of annexation arises in that county. The two county members shall be familiar with the area to be annexed and can survey local views and insight to the annexa- tion. The three state representatives shall serve four year terms coincident with that of the governor. State representatives shall be thoroughly familiar with Florida annexation laws as well as all other aspects and principles of annexation. In addition,.one state representative shall be designated as the secretary of the Commission and shall be responsibile for receiving appeals from con- cerned citizens who feel that an annexation has unjustly or illegally been ordered by a governing body. If, in response to an appeal of an effected citizen, any state commissioner feels that there has been an irregularity in the annexation proceedings or in the treat- ment of an effected citizen, he may call a public hearing of the Annexation Conimi.s ion for the purpose of reviewing and issuing a final decision on the annexation, 2.' y?, r Ytr '? •??i. .'::Y+i'a•?h," •.
