A RESOLUTION AUTHORIZING THE CITY ATTORNEY'S
OFFICE TO BRING AN ACTION TO SEEK CONSTRUCTION
OF TENNIS COURTS OR THEIR EQUIVALENT CASH VALUE
PURSUANT TO AGREEMENT THEREFOR.
WHEREAS, on October 6, 1975, an agreement was entered into by
FBC Land Corporation to construct four tennis courts-within the City of
Clearwater at a location chosen by the City; and
WHEREAS, the date for construction of these tennis courts has passed
and no effort has been made by the corporation to comply with the agreement;
and
WHEREAS, it is deemed necessary to bring action against FBC Land
Corporation to seek construction of the tennis courts or their equivalent cash
value;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney's Office be and it is hereby authorized to bring
an action against FBC Land Corporation to seek construction of the tennis
courts or their equivalent cash value.
