A RESOLUTION AUTHORIZING THE CITY ATTORNEY' S
OFFICE TO APPEAL THE DECISION OF THE CIRCUIT
COURT IN THE CASE OF RO BERT D. BICKERSTAFFE
VS. CITY OF CLEARWATER, ET AL CASE NO. 77-1023-7
WHEREAS, the Circuit Court on June 3, 1977, entered a
final order granting summary final judgment in favor of Plaintiff in-
validating the referendum portion of the general election held February
B, 1977; and
WHEREAS, the decision of the Circuit Court has been re-
viewed and it is the considered opinion of the City Attorney's office
that such decision should be immediately appealed to the Second District
Court of Appeals.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMI SSION OF THE CITY OF CLEARWATER,
FLORIDA, IN SESSION DULY AND REGULARLY
ASSEMBLED, AS FOLLOWS:
That the City Attorney's Office be and it is hereby authorized
to immediately perfect and prosecute an appeal to the Second District
Court of Appeals from the Order of the Circuit Court entered June 3,
1977, in the case of Robert D. Bickerstaffe vs. City of Clearwater, et al
Case No. 77-1023-7.
