RESOLUTION
No. 77 - 45
A RESOLUTION OF THE CITY COMMISSION OF CLEARWATER,
FLORIDA, REQUESTING THE PINELLAS COUNTY LEGISLATIVE
DELEGATION TO OPPOSE PASSAGE OF HOUSE BILL 571.

WHEREAS, House Bill 571 providing private property owners with a

potential right to compensation in excess of that guaranteed by the Constitution
is presently pending before the Appropriations Committee of the House; and
WHEREAS, the passage of House Bill 571 would impose an undue burden
on the valid exercise of legislative power to regulate by planning and other
means the use of property; and
WHEREAS, the need for such planning and other regulations still
exists in urban areas; and
WHEREAS, passage of House Bill 571 would increase the cost of
government in that local governments would have to budget for the potential
claims for compensation authorized by the bill; and
WHEREAS, the bill has the potential for involving local governments
in excessive litigation; and
WHEREAS, the bill has the potential for creating an imbalance in the
separation of powers principle in that it has a potential for unnecessarily
involving the court system in local government;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That for all the reasons set forth herein the City Commission
of the City of Clearwater, Florida, requests the Chairman and Members of the
Pinellas County Legislative Delegation to oppose passage of House Bill 571.
2. That a certified copy of this Resolution bi, forwarded forthwith
