A RESOLUTION REQUESTING THE PINELLAS COUNTY
LEGISLATIVE DELEGATION TO ACTIVELY OPPOSE
a;4,f PASSAGE OF HOUSE BILL 127,

WHEREAS, under the present law a municipality may only be sued in
tort in the county in which it is located; and
WHEREAS, House Bill 127 presently before the State Legislature

could change current law and w.Quld permit a municipality to be sued in tort
in other than the county where it is located; and
WHEREAS, a municipality Is not similar to a corporation for profit with
different places of business in various counties throughout the State; and
WHEREAS, the passage of House Bill 127 would impose additional and
unnecessary burdens on Florida municipalities, among which are unnecessary coat
burdens; a necessity to employ attorneys in counties other than the place of its
location; a necessity to defend itself in a location where it does not govern and
has no real contacts and unnecessary transportation costs in that municipal
employees and officials would be required to travel to other counties because
of such suits, and
WHEREAS, due to its character and functions a distinction should be
maintained between a municipal corporation and a corporation for profit as to
the place where it may be sued in tort; and
WHEREAS, the City Commission of the City of Clearwater wishes to
request that the Chairman and members of the Pinellas County Legislative
Delegation act to oppose passage of House Bill 127;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS;

I. That the City Commission of the City of Clearwater hereby
requests the Chairman and members of the Pinellas County Legislative
Delegation to oppose passage of House Sill 127 as being a bill that would
impose unnecessary burdens -on municipalities in excess of the benefit to
be derived.
2. That a certified copy of this resolution be forwarded to the
Chairman and members of the Pinellas County Legislative Delegation and
to the Florida League of Cities.
PASSED AND ADOPTED this 2119t day of April, A. D. 1977.
