RESOLUTION
No. 77 - 34
A RESOLUTION PROVIDING GENERAL AUTHORIZATION
TO THE CITY ATTORNEY'S OFFICE TO DEFEND THE
CITY OF CLEARWATER AND ITS ELECTED AND
APPOINTED OFFICIALS.
WHEREAS, from time-to-time the City of Clearwater and its elected
and appointed officials are sued in their official capacity; and
WHEREAS, the City Attorney's Office provides a defense in all such
actions; and
WHEREAS, past policy has required the City Attorney to submit
individual resolutions to obtain authority to enter into the defense of each such
lawsuit; and
WHEREAS, the City Commission desires to provide general authority
to the City Attorney;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Attorney's Office is hereby granted general authority
to defend the City of Clearwater and its elected and appointed officials in all
lawsuits resulting from official action.
2. That upon receipt of each such lawsuit the City Attorneyls Office
shall be required to provide written notification to each member of the City
Commission naming the lawsuit, numbering each in sequential order, and
the date it was received.
PASSED AND ADOPTED this 7th day of April, A. D. 1977.
