A RESOLUTION AUTHORIZING THE CITY ATTORNEY
TO BRING AN ACTION AGAINST GEORGE HUNT, INC.
AND COMMERCIAL CONTRACTORS FOR THE REMOVAL
OF TREES IN EXCESS OF A GRANTED TREE REMOVAL
PERMIT.
WHEREAS, the Community Plaza as part of the Countryside
w
Shopping Center Project is presently under construction; and
WHEREAS, the City of Clearwater had granted a tree removal permit
authorizing the removal of certain trees at the project site; and
WHEREAS, examination of the site discloses that trees have been
removed which were not included as part of the permit; and
WHEREAS, George Hunt, Inc. is the developer of the project and
Commercial Contractors is the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney is hereby authorized to bring an action on
behalf of the City of Clearwater against George Hunt, Inc. and Commercial
Contractors to recover damages by reason of the wrongful removal of trees
at the Community Plaza site in excess of the tree removal permit granted
pursuant to Ordinance No. 1623.
