R E S O L U T I O N
No, 77 - 32
A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO
BRING AN ACTION IN SMALL CLAIMS COURT TO SEEK
RECOVERY FOR DAMAGE TO CITY-OWNED PROPERTY.
WHEREAS, City-owned property, namely a fire hydrant, was damaged
recently in an automobile collision; and
WHEREAS, the hydrant sustained approximately $1450. 00,in damages;
and
WHEREAS, efforts to collect the same without asserting a claim have
not proved successful; and
WHEREAS, the vehicles involved in the collision were driven by
Edward Parsons and Elly Sellin Werner;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney is hereby authorized to bring an action in
Small Claims Court against Edward Parsons and Elly Sellin Werner to recover
damages in the approximate amount of $1450. 00 occasioned to a City-owned
fire hydrant,
PASSED AND ADOPTED this 7th day of April, A. D. 1977.
