A RESOLUTION AUTHORIZING THE FILING OF A CIVIL
ACTION TO OBTAIN COMPLIANCE WITH THE TREE
PROTECTION CODE SET FORTH IN ORDINANCE NO. 1623.

WHEREAS, H. L. Marion, Inc. is the apparent owner of a mobile
home park in Clearwater, Florida; and
WHEREAS, H. L. Marion, Inc., through its resident manager, had
previously applied for a permit to cut trees and was denied the same both
by the City Manager and the Board of Adjustment and Appeal on Zoning; and
WHEREAS, since the denial of such permit it has come to our attention
that the trees in question are being cut or otherwise trimmed without benefit
of a permit; and
WHEREAS, such action constitutes a violation of our current tree
protection code and it is necessary to bring an immediate action in order to
prevent the continuing violation of such code;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney is hereby authorized to file a suit against
H. L. Marion, Inc. in order to obtain compliance by the property owner with
the City of Clearwater tree protection code contained in Ordinance No. 1623,
and to do all things necessary to complete such legal action.
PASSED AND ADOPTED this 3rd day of February, A.D. 1977.
