RES0LTITION
No. 76 « 113
A RESOLUTION AUTHORIZING THE CITY ATTORNEY
PURSUANT TO SECTION 31 OF THE CHARTER TO _
INSTITUTE COURT PROCEEDINGS TO COLLECT A
SERIES OF PROPERTY DAMAGE CLAIMS
WHEREAS, the City Attorney's office presently has pending a
series of damage claims, being nine (9) in number, involving damages to
City-owned property; and
WHEREAS, efforts to collect such claims through utilization of
procedures other than court action has proved unsuccessful; and
WHEREAS, Section 31 of the Charter of the City of Clearwater when
court action is contemplated requires that the City Attorney obtain consent
from the City Commission to institute such action; and
WHEREAS, it would be in the best interests of the City to attempt to
collect such claims through such action;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney be and he is hereby authorized to institute
such court action as may be necessary to collect the nine (9) pending property
damage claims involving damage to City-owned property,
PASSED AND ADOPTED this 7th day of October, A. D. 1976.
