THE PURPOSE OF PROSECUTING CLEARWATER CITY

CODE VIOLATIONS IN COUNTY COURT
WHEREAS, since the adoption of Article V of the Florida Constitution,
local municipal courts have been or are in the process of being abolished; and }
WHEREAS, due to the burden imposed upon the Office of the State
- ,^ ''3< Attorney through the increased case load, several municipalities have opted
y; 1 to utilize a
municipal prosecutor to assist in prosecuting municipal ordinance
violations; and
WHEREAS, the City of Clearwater due to its growth has become more
involved in municipal code enforcement and thus needs a capability of providing "
r; enforcement of minor ordinance violations; and
:a I WHEREAS, the City of St. Petersburg presently prosecutes selective

4 " minor municipal ordinance violations in County Court; and'
WHEREAS, it would be in the best interest of the City of Clearwater '
rq ?, if the Office of City Attorney were designated as Municipal Prosecutor
thereby making available an additional means of providing enforcement
ki of minor municipal code violations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY r,
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
' FOLLOWS:
That the Office of City Attorney composed of the City Attorney and

4 Assistant City Attorneys is hereby designated Municipal Prosecutor for the

City of Clearwater for the purpose of prosecuting municipal ordinance
violations in County Court.
