76-82•a 4 RESOLUTION No. 76 - 82 4W 4W A RESOLUTION AUTHORIZING THE CITY MANAGER TO UTILIZE THE SERVICES OF THE FIRM OF SHACKLEFORD, FARRIOR, STALLINGS & EVANS, TAMPA, FLORIDA, TO DEFEND THE CITY COM- MISSION, CITY MANAGER, CITY ATTORNEY AND FINANCE DIRECTOR IN PAUL 14LANE V. PICOT FLOYD, ET AL, CASE NO. 76-6998-14. WHEREAS, Paul Kane has filed a lawsuit in Circuit Court naming as parties defendant all members of the City Commission, the City Manager, the City Attorney and present City Finance Director; and WHEREAS, by virtue of this lawsuit all segments of the governmental structure provided for in the Charter have been made parties defendant; and WHEREAS, Section 31 of the Charter would normally permit the City Attorney to defend such actions; however, the City Attorney has in fact been made a party defendant and thus part of the lawsuit; and WHEREAS, the posture of this lawsuit, the questions raised and parties named dictates that this action should be handled by someone not otherwise involved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: That the City Manager be and he is authorized to secure the services of the firm of Shackleford, Farrior, Stallings & Evans to take all actions necessary to defend the City Commission, the City Manager, the City Attorney and the Finance Director in the case of Paul Kane v. Picot Floyd, et al, Circuit Civil No. 76-6998-14. PASSED AND ADOPTED this 2nd day of August, A. D. 1976. Mayor.
