F } • !F ?} RESOLUTION No. 76 - 78 A RESOLUTION DIRECTED TO CIVIL SERVICE BOARD CHAIRMAN JOSEPH VERDI ADVISING HIM THAT HE IS IN VIOLATION OF THE CIVIL SERVICE ACT AND REQUESTING THAT HE IMMEDIATELY RESIGN WHEREAS, Joseph Verdi has announced that he will seek the seat for District 53 Florida House of Representatives; and WHEREAS, such announcement appeared in the July 8, 1976, issue of the St. Petersburg Times, accompanied by Joseph Verdi's picture; and WHEREAS, a story relating to Joseph Verdi's intentions entitled "Joseph Verdi declares intentions for House seat" also appeared in the same issue; and WHEREAS, the Civil Service Act presently in force in the City of Clearwater contains a form of resign to run law, which reads as follows: "Any member of the civil service board or employee under the provisions of this Act who becomes a candidate for any public office shall immediately resign from said board upon announcing his candidacy for said office. "; and WHEREAS, the City Attorney has examined the above law and when the above is compared with Section 99.012, Florida Statutes, a State resign to run law, it becomes apparent that the Civil Service Act imposes the requirement that a board member who becomes a candidate for any public office is required to resign from the Civil Service Board immediately upon announcing his candidacy; and WHEREAS, the term "announcing" as used in the Civil Service Act in the context of the above language means a publication or making known the fact of candidacy; and WHEREAS, the matter has been brought to the attention of the City Commission and the City Attorney has advised the Commission concerning the interpretation of the above captioned portion of the Civil Service Act; and •r , ',.' '.s, 1 r! t p WHEREAS, the City'Commission wishoe to advise Joseph Verdi, present Chairman of the Civil Service Board, that he is violating the Civil Service Act, and further wish to request that Joseph Verdi immediately resign from the Clearwater Civil Service Board; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the City Commission having been advised that Joseph Verdi has announced his candidacy for the District 53 seat in the Florida House of Representatives, such announcement having appeared in the July 8, 1976, ' issue of the St. Petersburg Times, and having consulted with and been advised by the City Attorney that the present Civil Service Act imposes upon Board ' Members and other employees subject to the Act the requirement that they immediately resign upon announcing their candidacy for any public office, hereby notifies Joseph Verdi, Chairman of the Civil Service Board, that he is presently violating the Civil Service Act. 2. That the City Commission hereby requests that Joseph Verdi immediately resign his position as a member of she Civil Service Board of the City of Clearwater, Florida. 3, That a certified copy of this Resolution be immediately forwarded to Joseph Verdi, 518 Richards Avenue, Clearwater, Florida.
