RESOLUTION

WHEREAS, the City Attorney on December 30, 1975, filed a motion
before the Civil Service Board requesting the Board to.require Alex D. Finch
to recuse himself in the forthcoming hearing to be conducted in the appeal of

Max G. Battle; and
WHEREAS, on December 31, 1975, the Civil Service Board decided

?,. that it did not have the power to require that AlexM. Finch recuse himself;
and
WHEREAS, it will be necessary to file legal action in order to obtain
a determination with respect to whether or not Alex D. Finch should be
required to recuse himself in the forthcoming appeal hearing;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER,` FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS

FOLLOWS:'
That the City Attorney is hereby authorized to go to Circuit Court
for the Sixth Judicial Circuit and do all things necessary to obtain a determination
with respect to the question relating to whether or not Alex D. Finch should be
required to recuse himself from the appeal hearing to be held in the case of
Max G. Battle.
