RESOLUTION
No, 75.. 140
WHEREAS, suit has been filed in the Circuit Court In and for
Pinellas County, Florida, styled William Gallant, et al vs. Cliff Stephens,
et al, being Circuit Civil No. 75-8681..15; and
WHEREAS, the City Commission desires to authorize the Legal
Department to intervene in said action in support of the construction to be
placed on Article VIII, Section 1 (h) of the Florida Constitution that municipalities
should not be subject to tax for services rendered exclusively for the benefit
of property and residents in unincorporated areas;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the Legal Department is hereby authorized to intervene in the
law suit filed in the Circuit Court in and for Pinellas County, Florida, styled
William Gallant, et al vs. Cliff Stephens, et al, the same being Circuit Civil
No. 75..8681-15, and to take any and all necessary action in such intervention.
PASSED AND ADOPTED this 16th day of October, A. D. 1975.
