RESOLUTION
No. 75 .. 81
WHEREAS, a suit has been filed in the Circuit Court in and for
Pinellas County, Florida, styled Derwin B. Smith, II, individually and as
Executor of the Estate of Derwin B. Smith, deceased; Chester B. McMullen,
Jr.; Elizabeth M. Massey, by her attorney in fact. Chester B. McMullen, Jr. ;
and L. H. Zinsser, by his attorney in fact, L. D. Zinsser, Petitioners, vs.
City of Clearwater, Florida, a municipal corporation of the State of Florida;
Gabriel Cazares, Karleen DeBlaker, John F. Rankin, Karen Martin, Joseph
L. Carwise, as and constituting the Mayor and City Commission of the City of
Clearwater, Florida, and Pinellas County Planning Council, a political sub-
division of the State of Florida, Respondents, being Circuit Civil No.
75-5356.-15; and
WHEREAS, the City Commission desires to authorize the Legal
Department to defend said suit and to take any and all necessary action
in such defence;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the Legal Department is hereby authorized to defend the suit
filed in the Circuit Court in and for Pinellas County, Florida, styled Derwin
B. Smith, II, individually and as Executor of the Estate of Derwin B. Smith,
deceased; Chester B. McMullen, Jr.; Elizabeth M. Massey, by her attorney in
fact, Chester B. McMullen, Jr.; and L. H. Zinsser, by his attorney in fact,
L. D. Zinsser, Petitioners, vs, City of Clearwater, Florida, a municipal
corporation of the State of Florida; Gabriel Cazares, Karleen DeBlaker, Jolui
F. Rankin, Karen Martin, Joseph L. Carwi.se, as and constituting the Mayor
and City Commission of the City of Clearwater, Florida; and Pinellas County
