RESOLUTION
No. 75 - 69
WHEREAS, it has been brought to the attention of the City Commission
of the City of Clearwater that Chapter 563, Beverage Law; Beer,,of the Florida
Statutes, containsa provision in Section 563. 02, sub-section (1) (a), that
vendors holding such off-premise sales licenses shall not be subject to zoning
by municipal and county authorities; and
WHEREAS, such a provision allows vendors operating places of business
where beer is sold only for consumption off the premises to not be subject to
any alcoholic zoning control by the municipality in which it is located; and
WHEREAS, this provision has caused problems within the City of
Clearwater and the City is desirous that this section be amended to give the
municipality and county authority to zone such areas for all alcoholic beverage
consumption and sale;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA',
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS:
1. That the City of Clearwater hereby officially requests and urges
that Section 563, 02, sub-section (1) (a) of Chapter 563, Beverage Law; Beer,
of the Florida Statutes, be amended to allow the municipalities and counties
to zone all areas within their jurisdiction for the sale of all types of
alcoholic beverages.
2. That certified copies of this Resolution be forwarded forthwith to
Governor Reuben Askew, Attorney General Robert Shevin, and to the Pinellas
County Legislative Delegation.
