RESOLUTION
No, 75 - 45
WHEREAS, suit has been filed in the United States District Court
for the Middle District of Florida, Civil Action File No. 75-150-T-K, by
Michels Island Village Pharmacy, Inc. against the Commissioners, City
r° Manager, and Director of the Building Department of the City of Clearwater;
and
WHEREAS, it is necessary that this suit be defended by the Legal
Department of the City and authority be given to proceed in the defense of
the suit by whatever action is deemed necessary and expedient;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Attorney is hereby authorized to defend the suit filed
in the United States District Court for the Middle District of Florida, Civil
Action File No. 75-150-T-K, by Michels Island Village Pharmacy, Inc.
vs. H. Everett Hougen, John F. Rankin, Joseph Carwise, Donald S. Williams,
and Karleen DeBlaker, as the Commissioners of the City of Clearwater,
Florida; Picot B. Floyd, as Manager of the City of Clearwater, Florida;
Edwin Blanton, as Director of the Building Department of the City of Clearwater,
Florida, and to proceed with such defense and prosecute any crass-claims
seeking damages and court costs by whatever action may be deemed necessary
and expedient.
2. That the same authorization is hereby extended to any other actions
in this or other jurisdictions filed by Michels Island Village Pharmacy, Inc.
on the same or related subject matter.
