RESOLUTION
No. 76 .. 1
WHEREAS, the City of Clearwater Employees Pension Fund has
boon set up by a Special Act of the Legislature of the State of Florida; and
WHEREAS, Chapter 166, Florida Statutes, the Municipal Home Rule
4 Powers Act, provides that nothing in said Act shall be construed to permit any
changes in a special law which affects any rights of municipal employees; and
WHEREAS, proposed bill has been filed with the Legislature of the
State of Florida which would provide that the City of Clearwater Employees
Pension Fund Act would become a municipal ordinance subject to change as
any other municipal ordinance; and
WHEREAS, the City Commission of the City of Clearwater, sitting as
Trustees of the City of Clearwater Employees Pension Fund, are opposed to
the passage of such legislation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, SITTING
AS TRUSTEES OF THE CITY OF CLEARWATER EMPLOYEES
PENSION FUND, AS FOLLOWS:
1, That the Trustees of the City of Clearwater Employees Pension
Fund hereby officially oppose the passage of any legislation which would change
the' status of the Special Act of the Legislature under which the City of Clearwater
Employees Pension Fund was established and is being administered and urge
that this legislation be withdrawn immediately from consideration by the
Legislature.
2. That certified copies of this Resolution be forwarded forthwith to
the Pinellas County Legislative Delegation in Tallahassee and to Senator
Henry B. Sayler.
