WHEREAS, suit has bec,n filed in the United States District Court
for the Middle District of Florida, Tampa Division, styled as The City of
Safety Harbor, a municipal corporation, and Claude Rigsby, Plaintiffs,
vs. William Birchfield, Herbert Brown, Paul Danahey, S. Curtis Kiser,
Douglas Roach and Edmund Whitson. Jr., Defendants, being Civil Action
No. 74-176-T-K; and
WHEREAS, the actions set forth in said suit were actions taken
by Herbert Brown in his capacity as City Attorney and were official actions
taken by him in said capacity; and
WHEREAS, it is desired to authorize the Legal Department to undertake
the defense of said suit and to authorize the payment of all costs therefor and
any appeals taken therefrom;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS:
That the Legal Department is hereby authorized to undertake the
defense of the suit filed in the United States District Court for the Middle
District of Florida, Tampa Division, styled as The City of Safety Harbor, a
municipal corporation, and Claude Rigsby, Plaintiffs, vs. William. Birchfield,
Herbert Brown, Paul Danahey, S. Curtis Kiser, Douglas Roach and Edmund
Whitson, Jr., Defendants, being Civil Action No, 74-176.,T-K, and any appeals
taken therefrom, and that the payment of all costs in the defense of said suit and
any appeals taken therefrom is hereby authorized.
