RESOLUTION
No. 74 - 138
WHEREAS, Bullard and Walling, Inc. was developing a tract of land
on U. S. Highway 19 adjacent to City-owned property; and
WHEREAS, Bullard and Walling, Inc. entered upon the City-owned
property without permission or authority and constructed a drainage ditch
thereon with heavy equipment machinery and as a result of such action
extensive damage was done to the City property; and
WHEREAS, negotiations have been carried on in an attempt to come
to an agreement as to repairing the damages and restoring the property to
its original condition; and
WHEREAS, such negotiations have not brought about a satisfactory
conclusion and it is, therefore:, necessary to file legal action in order to
receive just compensation for said damages;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney is hereby authorized to file a suit against
Bullard and Walling, Inc. for the damages done to City-owned property known
as Moccasin Lake Park, and to do all things necessary to complete such legal
action,
