RESOLUTION
? No. 74 .. 125
WHEREAS, a suit was filed in the Circuit Court of the Sixth
Judicial Circuit of the State of Florida in and for Pinellas County, styled
Robert M. Couf and Mary A. Brown, Plaintiffs, vs. Karleen DeBlaker, John
F. Rankin, Donald Williams, Joseph L. Carwise, H. Everett Hougen, Picot B.
Floyd, Paul Bergmann, Edwin Blanton and City of Clearwater, a Municipal
Corporation, Defendants, being Circuit Civil No. 74.6506-14; and
WHEREAS, on September Z7, 1474, Circuit Judge David Seth Walker
issued a Final Order which, among other things, gave the Plaintiffs thirty days
from said date to prepare and present to the Defendants their application for
a building permit together with the detailed complete building plans required
by the City; and
WHEREAS, the City Commission desires to authorize the City
Attorney to appeal the decision of the Judge if in his discretion he should feel
such action to be proper;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the City Attorney is hereby authorized to appeal the decision of
Judge David Seth Walker in the matter of Robert M. Couf and Mary A. Brown,
Plaintiffs, vs, Karleen DeBlaker, John F. Rankin, Donald Williams, Joseph L.
Carwise, H. Everett Hougen, Picot B. Floyd, Paul Bergmann, Edwin Blanton
and City of Clearwater, a Municipal Corporation, Defendants, if in his discretion
he should feel such action to be proper and timely.
