WHEREAS, it has been requested by Robert E. Heilman and
Heilman Restaurants, Inc., owners of certain real property in Clearwater
Beach Park First Addition and Clearwater Beach Park First Addition Replat,
in the City of Clearwater, Florida, that the City of Clearwater, Florida,
vacate a certain North-South allay; and
WHEREAS, after proper public notice and public hearing thereon, the
City Commission finds that said alley is not necessary nor required and it is
deemed to be to the best interest and advantage- of the City and the general public
that the same be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

The North-South alley lying between Lots 16 through 23, N°
inclusive, Block B, Clearwater Beach Park First Addition,
according to the map or plat thereof as recorded in Plat c

Book 15, page SO of the Public Records of Pinellas County, .,

Florida, and Lots 12 through 15, inclusive, Block A,
Clearwater Beach Park First Addition Replat, according
to the map or plat thereof as recorded in Plat Book 21,
page 21 of the Public Records of Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law, excepting
that the City of Clearwater hereby retains an easement for installation and
maintenance of all public utilities, including but not limited to water, electric
and storm and sanitary sewer lines, upon said described real property.
2. That the City Clerk is hereby directed to record this Resolution in
the Public Records of Pinellas County, Florida.
3. That a certified copy of this Resolution be furnished to Mr. Harry S.
Cline, Attorney at Law, PO Box 1878, Clearwater, Florida 33517.
