RESOLUTION
No. 74 -• 105
WHEREAS, it has been requested by High and Dry Marina, Inc. and
J. S. Services of Florida, Inc, , ownors of certain real property in Unit 5,
Island Estates of Clearwater, in the City of Clearwater, Florida, that the
City of Clearwater, Florida, vacate a certain portion of Dory Passage; and
WHEREAS, after proper public notice and public hearing thereon, the
City Cotnmlesion finds that said portion of Dory Passage is not necessary nor
required and it is deemed to be to the best interest and advantage of the City
and the general public that the same be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1, That the following:
The Northeasterly 90 feet of Dory Passage as shown on
the plat of Unit 5, Island Estates of Clearwater, as recorded
in Plat Book 51, page 34 of the Public Records of Pinellas
County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law, excepting
that the City of Clearwater hereby retains an easement for installation and
maintenance of all public utilities, including but not limited to water, electric
and storm and sanitary sewer lines, upon said described real property.
2. That the City Clerk is hereby directed to record this Resolution in
the Public Records of Pinellas County, Florida.
3. That a cextified copy of this Resolution be furnished to Allbritton &
Barber, Attorneys at Law, 425 S, Garden Avenue, Clearwater, Florida 33516.
