RESOLUTION
No. 74 - 88
WHEREAS, the City of Clearwater, Florida, a municipal corporation,
has acquired certain hereinafter described real properties for road right-of-
way and other public use purposes; and
WHEREAS, said City of Clearwater desires that the Board of County
Commissioners of Pinellas County discharge any and all lions for taxes
from the date of acquisition by said City held or owned by the County or the
State of Florida upon said lands heretofore acquired by said City of Clearwater
and to further provide that said lands shall be exempt from County taxation
so long as the same are owned and used for such public purpose; and
WHEREAS, Florida Statutes 192.59, Taxation; cancellation
r. of delinquent taxes upon lands used for road purposes, etc. , grants to
F` the Board of County Commissioners of Pinellas County, Florida, full
power and authority to accomplish this request; and
WHEREAS, in order to comply with the policy of said Board, the City
of Clearwater is willing to guarantee payment of taxes prior to the date of
transfer on the hereinafter described properties when the tax rolls reflect
the proper amount and the City is billed for that amount;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City of Clearwater hereby formally requests the Board
of County Commissioners of Pinellas County, Florida, to take all formal
action necessary to cancel and discharge any and all liens for taxes,
from the date of acquisition by said City, held or owned by Pinellas County
or the State of Florida, upon the lands acquired by the City of Clearwater
for right-of-way or other public use purposes and to provide that said lands
shall be exempt from County taxation so long as the same are used for such
public purpose, which said lands are described in the attached deeds which
by reference are made a part hereof.
2. That the City of Clearwater guarantees payment of taxes prior to
the date of transfer on the hereinabove described properties when the tax
rolls reflect the proper amount and the City is billed for that amount.
3. That a certified copy of this Resolution be delivered forthwith to
Mr. Merrett R. Stierheim, County Administrator for Pinellas County, Florida.

Grantor hereby binds itself that the premises are froo from encumbrances,
that it is seized of said premises In fee and that it will fully warrant and

'l'ire property hereinnbove conveyed is subject to the lien cif the
First (formerly General) MorLgage made by Lite former Atlantic Coast Line
Railroad Company, dated as of March 1, 1950, as supplemented and modified,
tinder which mortgage United States Trust Company of New York is Corporate
Trustee, and Trustee joins herein for the purpose of releasing and does hereby
release the property hereinabove conveyed from the lien of said mortgage pur-
suant to the provisions of Section 6.01 of Article Six thereof.
