RESOLUTION
No. 73 - 149
WHEREAS, the City Commission is concerned for the inconvenience
of citizens who go to the effort of being present for advertised public hearings
on zoning and annexation matters and then same are continued to a subsequent
date or are withdrawn; and
WHEREAS, the City Commission wishes to be fair to all concerned
while taking appropriate measures to prevent abuses of the Commission's good
will by certain applicants concerning said matters; and
WHEREAS, the City Commission desires to establish a policy to be
followed concerning requests for continuations, withdrawal of applications or
no representation at a City Commission public hearing or Planning s.nd Zoning
Board public hearing for all zoning changes and annexation and zoning requests:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the following policy is hereby established by the City Commission
[or all requests for continuations, withdrawal of applications or nO representation
at an advertised Public Hearing by applicants for zoning changes and anne:ltation
and zoning petitioners:
1. Request for continuation: If the request for c:ontinuation is for
a period of thirty (30) days or less, then no additiona.l a.dvertising
shall be necessary or additional notices required. If such request
for continuation is for a period over thirty (30) dayo, then the
public he.ll'ing shall be readvertised and notices sent to required
surrounding: property owners. costs for such advertising and mailing
shall be charged to the applicant unless the City Commission waives
such charges or is the party requesting the continuance.
2. Request for withdrawal: If written request for withdrawal is
received by the City Clerk seven (7) days or more prior to either
the Planning and Zoning Board public hearing or the City Ccmmission
public hearing, then notice of such withdrawal shall be sent to the
required surrounding property owners, costs for such mailing to be
charged to the applicant. If written request for withdrawal. is made
less than seven (7) days prior to either of said public hearings, then
no new application will be accepted for at least six (6) months thereaftel';
and if withdrawn priar to the Planning and Zoning Boa.rd public hearing,
then costs shall be charged to the applicant for notifying required
surrounding property owners of such withdrawal prior to thu City
Coinmission public hearing.
