WHEREAS, in order to provide drainage outfall for Woodgate of
Countrltside Subdivision within the City of Clearwater, it is necessary to acquire
a drainage easement across property situated in the unincorporated area of
Pinellas County, Florida, so as to connect with the existing drainage facilities;
and

WHEREAS, such drainage easement will also serve the adjacent
unincorporated areas and add to the drainage facilities of the area; and
WHEREAS, it has been determined that said drainage easement across
the property situated in a portion of Pinellas County, Florida, cannot be
acquired; and
WHEREAS, in order to complete this project and provide proper
drainage for said areas, the City of Clearwater desires to request the
Board of County Commissioners of Pinellas County, Florida, to institute
condemnation proceedings to acquire said necessary drainage easement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater hereby
respectfully petitions the Board of County Commissioners of Pinellas County,
f Florida, to institute condemnation proceedings against Sidney Colen, the
owner thereof, for an easement described as follows:
An easement for the construction and maintenance of
drainage facilities in Section 31, Township 28 South,
Range 16 East in Pinellas County, Florida, said easement
being more particularly described as follows: A strip of
land 35 feet in width and 350 feet in length, consisting of
the West 14 feet of the North 350 feet of the SE 1/4 of said
Section 31 and the East 21 feet of the North 350 feet of the
SW 1/4 of said Section 31.

Z. That the City of Clearwater. hereby agrees to reimburse Pinellas
County for all costs and charges involved in the condemnation and acquisition
of this drainage casement.
