73-47v j • I 3 r ' 1 1 { ? d A ! 4M eM .1 tit RESOLUTION No. 73 - 47 01121?1;1 WHEREAS, the Florida Uniform Traffic Control Law, Chapter 316, Florida Statutes, gives original jurisdiction over all State Roads throughout Florida to the Department of Transportation; and WHEREAS, said Chapter 316 gives original jurisdiction to a municipality over all streets and highways, except State Roads, located within the municipality; and WHEREAS, said Chapter 316 states that "no local authority shall erect or maintain any official traffic control device at any location so as to regulate the traffic on any State Road unless approval in writing : has first been obtained from the Department of Transportation; and WHEREAS, the Department of Transportation has transferred its jurisdiction on State secondary routes to certain Counties under the terms of maintenance agreements with those Counties; and WHEREAS, the City of Clearwater feels that the common goal of the City and the Department of Transportation to move traffic safely and efficiently can best be served by eliminating the time lag inherent in the present system between the date of request and the date of installation of traffic control signs; and WHEREAS, the City of Clearwater feels that this time lag can be be eliminated by the Department of Transportation transferring authority for certain traffic engineering activities to the local authority when the local authority employs traffic engineering personnel with qualifications acceptable to the Department of Transportation; and WHEREAS, such transferred authority would be conditional and could be rescinded by the Department of Transportation in the event of regulations imposed by the local authority which the Department of Transportation feels are not in the beat interests of traffic on the State Road; and -1w -Reeo.#73-47 4t ?., k"1{Y_?iy?4.i? l•":?iF1, i'i ` °r.'i:i{'r.Cr 2 ° M. .k'!!1![7??7? WHEREAS, the local authority will be required to inform the Department of Transportation of all changes made on State Roads; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWSs 1. That the City Commission respectfully requests the Department of Transportation to develop a policy which will enable those juriediations which have in their employ qualified Traffic Engineers to enact regulations upon State Roads and to place signs or alter pavement markings as deemed necessary by the local authority. 2. A certified copy of this Resolution shall be transmitted forthwith to the Department of Transportation, Tallahassee, Florida, and to the District Engineer, Department of Transportation, Bartow, Florida.
