RESOLUTION

WHEREAS, the Legislature of the State of Florida is considexing
a proposed revision of Article V of the State Constitution which wauld have
the effect of abolishing all Municipal Courts in the State of Florida; and
WHEREAS, Municipal Courts, in general and in majority, concern
themselves with offenses, parties and witnesses located within the geographic
limits of the respective municipality and hold Court in Caurtraams located
in the municipality; and '
WHEREAS, the abolishment of Municipal Courts would require t]-,;
Judges of the County Courts to be knowledgeable of,' and interpret, in addition
to all State Statutes and County Ordinances, the Urdinancos of each Municipality
within the County; and
WHEREAS, the increased burden which will be cast upon the prosecutoxs
and State Courts by being required to investigate, pxoaecute and try all
Municipal Ordinance offenses presently tried by local Municipal Courts will,
as a practical matter, so over..burden the system, that, of necessity, many
of such offenses will be permitted to go unpunished, whereby enforcement of
Municipal Ordinances, in a large part, will be non..existent; and
WHEREAS, elimination of Municipal Courts, as proposed by said
Constitutional Amendment, would hinder, rather than assist the administration
of justice;
NOW, THEREFORE, BE lT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater, Florida,
hereby officially goes on record as opposing any State Constitutional Amendment
provision which absolishes Municipal Courts.
