WHEREAS, House Bill 5436 (Chapter 70-906 was pissed by the
Florida State Legislature with an affective dnto of Octnbar 1, 1870; and
WHEREAS, said bill provided that any mtisnictpaIity in Pinollas County
is authorized and granted the power to install, improve and maintain water
or sewer lines and facilities outside o[ the boundaries of ouch municipality
and to assess the abutting property so bandfitted by such facilities when (I}
the municipality receives a petition requesting such sssrvica signed by at least
fifty per cent of the property owners within a given unincorporated geographic
area, or (2} when the Florida Division of Health shall officially notify the
municipality that a health hazard oxists within a given unincorporated geographic
area that is hazardous to the municipality as determined by a field survey
and appropriate testa of the 5tatc Division of Health; and
WHEREAS, the City of Clearwater has xeceived a petition requesting
such service signed by over fifty per cent of the property owners within the
unincorporated geographic area of Terra Alto Estates, according to the map or
' plat thereof as recorded in Plat Book 45, pogo 5af the Public Records of
Pinellas County, Florida; and
WHEREAS, ir- accordance with said House Sill 5436 (Chapter 70-906},
the City Commission passed Resolution No. 71-27 declaring its intention to
hold a public hearing to determine the need and necessity to construct sanitary
sewer lines and facilities in the unincorporated geographic area of Terra Alto
Estates, according to the map or plat thereof as recorded in Plat Book 45, page 5
of the Public Records of Pinellas County, Florida, on the l7th day of May,
1871, at 1:30 P. M. in the City Hall Auditorium, 112 5. Osceola Avenue,
Clearwater, Florida; and

in accordance ~~ith the terms and requirements of said House Bill 5436
tChapter 70-gobj, and said public hearing was daly held on s$id data, and
than continued until September Z0, 1g71, and thereupon completed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OI• CLEARWATER, FLORIDA,
IN SESSION DULY ANA REGULARLY ASSEMBLED, AS
FOLLOWS: '
1. After proper public hearing the City Commission finds that no
valid objections have been filed with the City Cleric or that the objections
made axe insufficient, and therefore, it is ordered that the construction of
sanitary sewer lines and facilitieB in the unincorporated geographic area of
Terra Alto Estates, according to the map ar plat thereof as recorded in
Plat Book 45, page 5 of the Public Records of Pinellas County, Florida,
shall be completed in accordance with plane and specifications therefor filed
in the Office of the Clark of the City of Clearwater and the City Manager and
the City Engineer are dixacted to proceed with such improvements as an
assessment groject and in accordance with the procedure as provided in
House Bill 5436 (Chapter 70-906}, passed by the Florida State Legis]a.ture,
with an effecti`e date of October 1, 1g7Q.
2. After completion of the construction of the sewer lines and facilities,
the City shall assess the actual coat thereof against the property abutting said
sewer lines and facilities and said costa shall be itemized and subject to audit.
3. It is hexeby determined at this public hearing that the price or rate
charged for the sewer service shall be no more than fifty per cent (50°jc~ higher
than is charged for a like class of service to a like class of users ox consumers
within the municipal boundaries of said City of Clearwater.
